A consumer asked this question after they disputed an item on their credit report and the creditor had verified the debt.

They wanted to keep disputing the debt but I warned them that if the debt was originally disputed through the CRA’s (credit reporting agencies) then they will just make a notation in their file as “frivolous” and it will be much harder to get the item removed from your credit report.

Never dispute an item on your credit report directly to the creditor. Alway dispute items directly to the CRA’s that way if the creditor does not get back to the CRA within 30 days to verify the debt it will be deleted from your credit report.

I told the person to send a “method of verification”  letter to the CRA. What this does is that by law,  per FCRA  (Fair Credit Reporting Act) the CRA has to provide you their method of verification when they validated the debt. They must provide you the contacts name, phone number and address that they contacted at the creditor to verify the debt within 15 days.

Here is the beauty of this….

Most creditors communicate to the CRA’s and the CRA’s communicate to the creditors via special software via the web based E-OSCAR System (On-line Solution for Complete and Accurate Reporting) where they never really speak to a real person to validate a debt.

Sooo……

If they can’t provide the person to whom they spoke with to you then the item will be removed from your credit report within 15 days.
